WARRANTY PERIOD AND SCOPE: B & H Commercial Services warrants the installation of Protect-All Flooring against seam failure,improperly sealed drains or base material allowing water penetration,separation of flooring from substrate due to improper adhesive application,installation of defective materials,improper installation of stainless steel accessories or base trim,and damage or failure of the flooring system caused by an employee or agent of B & H Commercial Services,Inc. for period of THREE (3), FIVE (5) OR TEN (10) years from date of installation.

EXCLUSIONS: This warranty does not cover damages resulting from negligence,intentional misconduct or other destructive behavior on the part of the facility owner or its employees,agents,vendors or invitees including but not limited to;cutting with sharp objects,damage from other trades,dropping hot grills,skillets or similar objects onto floor surface,drain tampering,repairs and or renovations made to facility following flooring installation completion that alter,penetrate or damage the flooring installation,improper use,electrical or plumbing repairs made after flooring installation,improperly cured or prepared sub-floors,building damage caused by fire,flood,or other acts of God,or any repairs made to the floor system during the warranty period that are conducted by personnel not specifically authorized by B & H Commercial Services to make such repairs.

REMEDIES: In the event a warranted failure or problem to a B & H Commercial Services floor system becomes apparent during the warranty period specified herein,B & H Commercial Services shall at its own expense make the necessary repairs to the floor system.

THE REMEDIES STATED HEREIN ARE THE SOLE AND EXCLUSIVE REMEDIES FOR ALLEGED FAILURE OF THE B & H COMMERCIAL SERVICES FLOORING SYSTEM. B & H COMMERCIAL SERVICES DDIISSCCLLAAIIMMSS LIABILITY FOR CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST PROFITS AND/OR DAMAGE TO BUILDING AND/OR CONTENTS. ANY IMPLIED WARRANTIEES OF MERCHANTABIILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMIITED IN TIME TO THE DURATION OF THIS EXPRESS WARRANNTTY. SOME STATES DO NOT ALLOW EXCLUSION OR LIMATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LIMITATION OF THE DURATION OF THE IMPLIED WARRANTIES, SO THE ABOUT LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
